Auto Care Association State Government Affairs Update: June 5, 2025

  • Bills on Electronic and Appliance Product Repairs; Regulations:
    • TX HB 2963 was sent to the governor on June 2, 2025. The bill requires original equipment manufacturers to provide independent repair providers and owners with access to necessary repair resources for most digital electronic equipment sold in Texas, with several exemptions, and establishes exclusive enforcement by the Attorney General starting September 1, 2026.
    • CA SB 712 passed the Senate on June 4, 2025. The bill fully exempts motor vehicles at least 35 model years old, with historical plates and collector insurance, from California’s smog check requirements starting January 1, 2027.
    • RI SB 884 was passed by the Senate on June 4, 2025. The act mandates powered wheelchair manufacturers to provide repair information and tools to independent repair suppliers and consumers, prohibits prior authorization for repairs, and requires suppliers to service sold wheelchairs, enhancing repair accessibility for consumers.
    • OR HB 3981 was referred to House committee on June 4, 2025. The bill postpones by one year the enforcement of responsible end market requirements for recycling in Oregon, delaying related obligations and enforcement actions until July 1, 2026.
    • OH HB 210 passed the House on June 4, 2025. The bill exempts quantum computing and sensing devices from the 'Consumer Repair Bill of Rights Act' in Colorado, effective January 1, 2026, unless challenged by a referendum.
    • HI SB 1216 was signed by the governor on June 3, 2025. The bill enforces stricter regulations and penalties on vehicle and moped inspections concerning noisy mufflers and exhaust systems, including increased fines and potential suspension of inspection station permits for repeated violations.
  • Bills on Right to Repair and Equipment:
    • MI H.B.4549 was referred to committee on June 4, 2025. The bill updates Michigan's Motor Vehicle Service and Repair Act by introducing auxiliary repair facilities, increasing registration and certification fees, strengthening consumer protections, and modernizing regulatory requirements for motor vehicle repair businesses, effective January 1, 2026.
    • CO HB25-1330 was signed by the governor on June 3, 2025. The bill exempts quantum computing and sensing devices from the 'Consumer Repair Bill of Rights Act' in Colorado, effective January 1, 2026, unless challenged by a referendum.

NV AB 407 was signed by the governor on May 30, 2025. This bill requires manufacturers of mobility devices for people with disabilities to provide fair access to repair information, parts, and tools, prohibits anti-competitive repair restrictions, and classifies violations as deceptive trade practices.

state updates

Twenty-one state legislatures are in regular session. Maine, Missouri, and Mississippi are in special session.

  • Washington has passed new right to repair laws to improve access to parts and services for wheelchair users and digital device owners. SB 5680 and HB 1483 will require manufacturers to provide tools, parts, and documentation for repairs, reducing the months-long wait many disabled residents have faced. Advocates say the laws are a major step toward treating mobility as a civil right.
  • The Ohio House has approved HB 210, a bill that cracks down on catalytic converter theft by tightening scrap metal sales regulations and increasing penalties for repeat offenders. The legislation would require detailed transaction records and proof of vehicle ownership. It now heads to the Ohio Senate for further consideration.

Oregon has passed landmark legislation extending consumer privacy protections to data collected by modern vehicles. Under HB 3785, automakers must honor requests to access or delete personal information and halt the sale of such data for targeted ads. The law positions Oregon at the forefront of digital privacy in the auto industry.
